Former Society Director Ron Hill of the Aberdeen Dark Blues, then asked “if we vote yes, can we categorically state that we will never go below 51%? Could the Dundee FC board not over-rule our wishes?”

Stuart Murphy took this question; “there is an embargo on the Directors issuing more shares until 14th September. It is technically possible to override the Society Board with the current constitution of the club board, but that is likely to change in the next few weeks and probably reduce in number, so this is unlikely to happen. However, it would still be a question for the Club Board.

Ron added “if the principle is to retain 50% then, can the Club Board still circumvent this

Again, Stuart Murphy stated that nothing could be done until at least 14th September, but technically, after 14th September, then at the moment, yes.

Scott Glenday added that “we want to know what the fans want, and this is your opportunity to tell us.”

Fraser MacDonald then answered “Company Law states that individuals must act in the best interests of the Company, so the Board must act in the best interests of Dundee FC. The board of the Club will be given a mandate by the members, and so even if there was a perceived conflict of interest, acting to bring in funds versus acting against the fans’ wishes, it would be easy to justify acting as the fans have instructed.

Scott came in again “As an elected fans’ rep who works hard every day for the Society and the Football Club, I’m very disappointed that there isn’t a bigger turnout. Not enough people communicate properly – this is your opportunity to do just that, tell us what you think, and give us a mandate to move on.”

Harry MacLean then added that if it was the fans’ wish to retain a 51% shareholding, he would not allow it to be overruled by the Club Board. He also pointed out that all seven Club Directors are Society members. Harry also said he would resign if the club board tried to overrule the fans' wishes.
